It is up to the student to know their rights and reach out to a Title IX Attorney in the Pennsylvania area that can help. Title IX is a federal law that is the same across state lines. Because of this, you can get accurate representation with a Title IX from any state that you would like.

Title IX Accusation Potential Consequences

Suspension

A suspension can have severe consequences on your future. It could make it difficult to get into another school as well as affect your graduation. This serious interruption of studies can possibly be avoided with the help of a Title IX Lawyer in Pennsylvania that has your best interest in mind and also knows the law. Getting a suspension can be career-altering if you cannot get into a university or college to continue and complete your studies.

How will the other university find out that you have a suspension? Upon filling out the transfer application, you will be asked to sign a FERPA form. This allows the first school to send your records to the school you are transferring to. This will contain the suspension information and the investigative findings.

Expulsion

In the event you are expelled, this information will also be included in your records. When you apply to a new school, you will need to address the reasons for expulsion. If you fail to disclose the disciplinary action and the school becomes aware of it, your acceptance can be revoked.

Degree Revocation

In some cases, universities will revoke your degree upon the findings of a Title IX violation or any other student misconduct, for that matter. If you have already gotten a degree and were working on adding to it, you might want to consider hiring a Title IX Attorney in Pennsylvania to better represent you.

Loss of Financial Assistance or Athletic Scholarship

According to the National Collegiate Athletic Association, if a student cannot be as involved with their sports activities as planned, the university can reduce or cancel the scholarship. When a student is found guilty of serious misconduct, the discipline might be that they can no longer continue playing sports or intercollege activities. This could threaten their scholarships and financial assistance. A Title IX lawyer in Pennsylvania will address these issues.

Loss of Eligibility

Being accused of a Title IX violation may result in a student losing his or her eligibility to be a part of college athletics. This could mean not only academic but also athletic and financial consequences due to lost scholarships or professional career opportunities.

Loss of Leadership Positions

For those students who participate in leadership roles within student organizations, they may be removed from such positions if accused or found guilty of a Title IX violation.  A student that is active in the military and working as a cadet in the ROTC program could face disenrollment, loss of a scholarship, forfeiture of a military commission, and immediate repayment of previous scholarships already awarded.

How We Can Help

We work with students to provide counsel and advice to help navigate the difficulties and stress of Title IX proceedings. We understand the laws and actively participate in the Title IX investigations, support the student and counsel them when needed. When there are associated misdemeanor or felony charges, we are there to assist in court. A Title IX Attorney in Pennsylvania is on your side, helping you each step of the way.

Title IX Investigations

Your rights should be upheld throughout the process. This means that you are included in all aspects of the Title IX investigation. The investigation process includes:

  • Notifying all parties involved
  • Gathering evidence
  • Reviewing all information
  • Writing the report of the findings

You are allowed to have an advisor, such as a Title IX lawyer, present at every meeting and the right for you both to review the evidence that was gathered against you. You and your Title IX attorney will also receive a copy of the investigation report once complete.

Investigations typically will take approximately 60 days. However, there is no law that states they have to be completed in that amount of time. Sometimes, if the case is complex, it could take longer. According to the DOE Office for Civil Rights, the length of the investigation will vary based on factors such as the number of witnesses, incidents, and complainants.

Ensure You Receive Due Process and Fairness and Hold the College Accountable

There are federal guidelines in place for these cases. A Title IX lawyer in Pennsylvania will hold the university accountable and protect your due process rights. Due process is in place for a reason, and without a Title IX attorney, you might not get your fair shake. Proper representation ensures your rights are protected and that you have a strong defense through the investigation and hearing process.

Cross-Examination

Cross-examination is an effective tool in testing the credibility of the witnesses. Both parties will have the opportunity to question witnesses, as well as the other party, at a hearing. Advisors cannot ask about the past sexual behavior of the complainant. They can only ask questions that are relevant to that particular case.

Gathering Evidence

A Title IX attorney will help prepare your opening statement and help prepare you for your interviews. They will also assist you in the collection of evidence and finding witnesses to get their statements.

Preventing and Pursuing Retaliation Claims

Whatever you do, don’t try to contact your accuser, or this could be considered retaliation. Do not try to contact them in any way, whether in person, over the phone or through text or email. Retaliation claims are prevalent. You can also be considered responsible if a third party contacts the accuser. The best thing to do is to sit and let the investigations figure it out. If you experience similar retaliation due to the nature of the allegations, your Title IX lawyer in Pennsylvania can also assist and pursue a retaliation claim on your behalf.

Civil Suit Defense

You may find yourself sued by your accuser, even if you were not found guilty of policy violations. Your Title IX attorney in Pennsylvania will defend you in such a case.

Our attorneys have the experience necessary to help you handle felony or misdemeanor charges in court. If you are found in violation of school policies and charges are brought on, your Title IX lawyer in Pennsylvania who has been by your side during the investigations already knows the case and evidence and can therefore help you build an effective defense.

Here in the great state of Pennsylvania, we have some very large universities spread out throughout our major cities. The University of Southern Pennsylvania, located in Los Angeles, is an excellent option as it is close to one of the largest airports in the US, LAX. You could also choose San Francisco State University, located in beautiful San Francisco. Here, you could take a minute to enjoy the Golden Gate Bridge, see Alcatraz and maybe catch a San Francisco 49ers game.

The University of Pennsylvania is another great option for higher education located in beautiful San Diego. While there, you could take a trip to the San Diego Zoo and visit the USS Midway, a museum located there.

If you enjoy parks, there are several national parks in Pennsylvania. These include Yosemite National Park, Sequoia National Park, and Joshua Tree National Park. Pennsylvania is a wonderful place to go to school, but also a wonderful place to visit.

Pennsylvania

Pennsylvania is a state with a ton of rich history.  Here you will find quite a few colleges and universities that will allow students to study a large variety of majors.  Some of these are:

While your student is studying at these colleges and universities, there is also a lot of history that you can take in.   Let’s take a look at some of the historical places of Pennsylvania.

Independence hall is located in Philadelphia and is where the Declaration of Independence was signed. It is located next to the National Constitution Center and congress Hall where the Bill of Rights was ratified.  This is a place that is a must see if you are planning a trip to Pennsylvania.  The Liberty Bell is also just a short walk from this location, which rang as the Declaration of Independence was signed.

Historical Places in Pennsylvania

Gettysburg is another historical place that is a must visit.  Here is where the largest land battle that ever took place on US soil was fought.  Here you will find a visitors center that talks about this historic place.

An hour drive from Pittsburgh and you’ll find Fort Ligonier which was used during the French and Indian war.  This fort was constructed in 1758 and the use of it ended in 1766.  While it wasn’t in use long, this fort has been opened up to the public and now is a place where festivals are thrown.

Just 19 miles away from Philadelphia is Valley Forge.  This is another historical location.  Here is where George Washington left troops for the winter.  Here you will find log cabins that are recreated and the place where Washington’s headquarters sat.

Of course this is only the tip of the history that can be found in Pennsylvania, as it is home of some of the first cities in the US.

Other Things Around Pennsylvania

However, there are all kinds of other things to do here as well.  Hersheypark is a huge chocolate themed amusement park that you could visit.  Pennsylvania is home to Hershey Chocolate and you can also take a tour of the factory while on a visit.

Eastern State Penitentiary was once a place you didn’t want to go. However, now it is open to the public for tours.  This was once home to some of the most famous criminals, making it now a destination spot for some.

The Philadelphia Zoo is great to visit if zoos up your alley.  This zoo is home to 1300 plus animals and is one of the oldest zoos in the nation.  It was opened in 1874 and the admission then was a mere $0.25.  Today, it is used to help keep certain breeds from extinction and is a breeding zoo.

Some outdoor things to enjoy are the Camelback Mountain Resort, Blue Mountain Resort and Jack Frost Ski Resort if you are up for skiing.  Pennsylvania has some great skiing areas such as these and more.  If you don’t ski, you can enjoy the cabins and resorts on their own!

A Client’s Tips For Facing A Title IX Investigation

I OFFER THE FOLLOWING TIPS

For students who may be involved in a Title IX or related matter, I offer the following tips. First, I recommend that you call a Title IX lawyer before you make any other move. Following that step, one should consider staying away from public statements on the matter. I also recommend that this public silence be countered with engagement in therapy and frequent self-care. Similarly, reach out to the appropriate contact at your school to coordinate supportive measures so that you may continue with your academics. Establishing a list of hobbies and rituals to ground myself was incredibly helpful throughout the ups and downs of the case.

Kristina and Susan are very competent ...

and experienced attorneys in Title IX and higher education law who treat their clients with integrity and compassion. Highly recommend this team!

Susan Stone and Kristina Supler represented our male college freshman...

against a false Title IX claim of non-consensual sexual intercourse. Current Title IX laws are strongly slanted in the accuser’s favor, and our son was denied due process by the university. This legal team expertly highlighted the accuser’s false accusations, while exposing the university’s many inconsistencies. They were there when we needed them – quick to take our phone calls or respond to our questions and concerns. Without their expert legal advice, our son would have likely been another silent and unfortunate victim of current Title IX university policies. We give Susan and Kristina the highest of recommendations!

I was a member of a fraternity at a public university...

that was kicked off campus for reported hazing. My involvement with the fraternity was unaware of any misdeeds being done, and was shocked when the school charged me with failure to report hazing. That’s when I contacted Susan and Kristina, who were extremely helpful and wonderful to work with. Thanks to them they helped guide me through collecting proof of my innocence, which ended up leading to the result we wanted of no charges against me. I highly recommend their service to anyone who might need it!

You are the utmost professional counselor...

On behalf of my family and me, I would like to thank you for the excellent guidance you provided to us. You are the utmost professional counselor. We are grateful for your expertise during a difficult time.
