What Is Title IX?
Title IX of the Education Amendments of 1972 is a federal civil rights law that prohibits sex discrimination in schools. Sexual discrimination includes sex harassment. Any public school or school that receives federal funding is subject to the prohibitions regarding sexual discrimination under Title IX. As such, Title IX applies to K-12 schools, colleges, universities, charter schools, other educational institutions, and federally funded educational programs, including prisons, museums, and libraries.
Different Types of Title IX Cases
While Title IX is often associated with college athletics, it is a broad law that encompasses everything from sexual violence to employment discrimination. Some of the most common types of Title IX cases include the following:
- Sexual discrimination: A student or employee can file a Title IX complaint if they believe they were discriminated against due to their biological sex.
- Gender discrimination: Gender discrimination occurs when one gender is treated more favorably than another.
- Sexual harassment: Sexual harassment that alters the terms of employment or negatively affects the student’s education can be actionable under Title IX.
- Discrimination against parents: Students who are parents who are discriminated against due to their parental status, temporary disability related to pregnancy, or nursing status can file a Title IX claim.
- College athletics discrimination: Being denied to participate in an athletic team, decreased playing time, a change to a less desirable position, or inadequate funding on the basis of sex can provide
- Sexual assault: Title IX violations can include sexual assault, especially if the college or university has not responded promptly or appropriately to the allegations.
- Dating violence: Title IX can also extend to domestic violence situations.
- Retaliation: Unlawful retaliation includes any type of adverse treatment in response to someone reporting unlawful discrimination or harassment. Retaliation could include a reduction in grades, suspension from a program, harassment or mistreatment by professors or administrators, job loss, a decrease in pay, a material change in job duties, termination, or a refusal to provide a positive reference.
Our Title IX defense lawyers regularly represent individuals accused of these types of Title IX violations.

The Title IX Process
Each individual school, college, university, or program must create its own Title IX policy, so there can be major variations in how these types of cases are handled. However, a typical Title IX case involves the following process:
- Complaint: The process officially begins when the alleged victim makes a formal complaint and the matter is referred to the Title IX office.
- Notice: The Title IX coordinator informs the complainant and respondent of the complaint and their rights under Title IX.
- Investigation: A formal investigation is conducted, which may include interviewing the parties, identifying other witnesses, and reviewing submitted evidence.
- Investigative report: The Title IX investigator prepares a report that summarizes what they uncovered with their investigation.
- Response: Both parties have an opportunity to respond to the investigative report.
- Hearing: Some schools provide an opportunity for a live hearing, which functions similarly to a trial. The accused can ask witnesses questions and defend themselves. At the end of the hearing, the decision makers announce their decision and possibly any sanctions.
- Appeal: The parties have an opportunity to appeal the decision.
Possible Defenses to Title IX Allegations
If you are accused of violating Title IX, it’s important that you have a robust understanding of the exact nature of the charges against you. Your defense should be tailored to the particular details of your case. Depending on the circumstances, defenses may include:
- Memory issues: Many Title IX cases revolve around situations where drugs or alcohol were involved. The complaining party may not accurately remember what happened and may assume the worst. It may be possible to present compelling testimony, text messages, or videos that show that the facts are different than what the alleged victim alleges.
- Miscommunication: In matters related to sex, harassment, or discrimination, miscommunications may be common. Someone may have said or done something that the other party interprets in another way. Sometimes, the parties are relying on body language alone.
- Consent: Consent can be a defense in some Title IX cases. However, many schools require affirmative consent, so it’s not enough to show the alleged victim didn’t say no. You might have to show they said yes.
- False allegations: Unfortunately, some Title IX cases arise from false allegations. A student might fabricate or exaggerate claims against another student, professor, coach, or other party to seek revenge or for other ulterior motives.
Our experienced attorneys can carefully review your case to determine the best defenses to raise on your behalf.
Rights Under Title IX
If you are being accused of Title IX violations, you have certain rights that you should be aware of, including:
- The right to due process, including the right to be informed of the charges against you and an opportunity to defend yourself
- The right to select an advisor of your choosing to assist throughout the Title IX investigation process
- The right to be informed of your rights and the Title IX process
- The right to a fair and impartial investigator
- The right to a hearing when that right is included in the Title IX policy
- The right to prepare questions for witnesses at hearings
- The right to a pre-established standard of proof
- The right to present witnesses and evidence in support of your defense
The accused also has certain rights throughout the process, including the right to interim support measures, which can sometimes have a negative impact on the accused, such as having to move out of a dorm or change on-campus jobs.
Title IX is a constantly evolving area of the law. Many schools lag behind the rules and are unprepared to provide a process that incorporates the latest changes and interpretations.
