Immediate Consequences of a Title IX Accusation

Many people think of American justice standards, such as “the presumption of innocence,” and don’t realize that they could be facing immediate actions that can affect their lives and education. Under the heading of “supportive measures,” a person who has only been accused of violating Title IX, not even responsible for a violation, may face the following immediate consequences:

  • No-contact orders: Many schools respond to Title IX complaints by filing a no-contact order against the accused. This order instructs you not to have any contact with the complainant.
  • Escort services: The accuser could begin being escorted to classes, work, and other activities on campus, which could raise questions for others and be embarrassing for you. 
  • Schedule changes: Due to the no-contact order, you might have to change your class schedule so that you are not in violation of it. This could disrupt your studies or even extend your time in college if you are unable to complete a mandatory course for your degree within the same term.
  • Job suspension: If you work on campus, you could be suspended or dismissed from your job.
  • Housing changes: Your housing assignment might also be changed as part of compliance with the no-contact order.
  • Ban from participation in sports and extracurricular activities: Interim measures could also ban the accused from participating in sports or other extracurricular activities.

Long-Term Consequences If You Are Found Responsible for Violating Title IX

  • Suspension or expulsion: You could be suspended or expelled from school. If you try to apply to another college or graduate school, other schools will likely learn of the findings in your student record, which may prevent you from being accepted and derail your future career prospects.
  • Degree revocation: Even if you have already graduated by the time your Title IX case concludes, you could still face consequences, including the possible revocation of a degree that has already been awarded to you.  
  • Loss of financial aid: You can lose financial aid, including merit scholarships, loans, grants, athletic scholarships, and academic scholarships. Without this funding, you might be unable to finish your education.
  • Dismissal from sports teams and leadership positions: You could be cut from sports teams, removed from leadership positions, and banned from participating in extracurricular activities.

What Must Be Proven to Show Responsibility in a Title IX Case

This standard of proof is much lower than that of “by proof beyond a reasonable doubt” required in court.

Title IX Investigative Process

Each school handles Title IX cases differently, but many use the following structure:

  • Receipt of complaint: The case officially begins when the college receives a complaint of a Title IX violation. The case may be referred to the Title IX coordinator. 
  • Notice: The school or Title IX coordinator provides the parties with written notice of the allegations. This may include instructions on their rights.
  • Investigation: A Title IX officer or independent investigator verifies the allegations that were made in the complaint. They interview the complainant and respondent. They may collect evidence, which could include physical and digital evidence. They may interview other witnesses who observed some of the actions that provided the basis of the complaint. Some schools end the process here, while others proceed with a hearing.
  • Hearing: If your school allows a Title IX hearing, the evidence against you that was gathered during the investigation is presented to a hearing officer or panel. During this step in the process, witnesses may be called and questioned. The parties may also testify. At the end, the panel determines responsibility. 
  • Sanctions: If the hearing panel determines you were responsible for violating Title IX, the panel may issue sanctions against you.
  • Appeal: You and the complainant may have limited rights to appeal the decision, but the legal grounds are often narrow, such as the proper procedures not being used or bias affected the outcome.
