Who Is Involved in a Title IX Case?
It can be helpful to know who can be involved in a Title IX case and their role. Involved parties may include:
- The complainant: The complainant is the alleged victim in the case. Their interests are directly adverse to yours. You should not contact them after Title IX allegations arise.
- The respondent: You are the respondent, the person responding to the claims against you.
- Advisors: Title IX policies generally allow the complainant and respondent to have an advisor who explains their rights and guides them through the legal process. KJK can act as your advisor.
- The Title IX coordinator: The Title IX coordinator oversees the college’s compliance with its Title IX policy.
- The investigator: The investigator may work directly for the school or be an independent party. The investigator gathers evidence, interviews parties, and reports their findings.
- The hearing officer: At schools that offer hearings, the hearing officer conducts live hearings, evaluates evidence, hears testimony, and issues findings and sanctions. Some colleges have a hearing panel rather than an individual officer.
Steps in the Title IX Process
While every Title IX case is unique, the usual steps in the process include the following:
- Notice of allegations: The Title IX coordinator provides formal notice of allegations, which states the allegations against the respondent, to the parties. They also refer to relevant policies and the parties’ procedural rights.
- Investigation: The investigator interviews the parties and any identified witnesses. The parties may provide statements and submit evidence.
- Hearing: The school may have a live hearing where a hearing officer or panel hears testimony and makes a decision.
- Appeal: You may be able to file an appeal due to procedural errors, newly discovered evidence, or bias.
