Title IX Lawyer in Michigan

Serving students & Faculty nationwide

Why do you need a Title IX Lawyer in Michigan? Being accused of a Title IX violation can really take a toll on your overall studies. It can affect your future career and interfere with your graduation plans. When someone is accused of a Title IX violation, the school will typically launch an investigation on the student. It is up to the student to know their rights and reach out to a Title IX Attorney in the Michigan area that can help. Title IX is a federal law that is the same across state lines. Because of this, you can get accurate representation with a Title IX from any state that you would like.

You have the right to access your education and protect your future. An experienced Title IX lawyer can help provide you with the representation you need. You are entitled to due process and should be able to continue your education while the investigation is going on. Some schools may withhold this information unless you have a Title IX attorney in Michigan present.

According to the Title IX of Education Amendments Act of 1972, they cannot discriminate based on gender if the school receives federal funds. To maximize your chances for a better outcome to your case, you need to find yourself a Title IX Attorney in Michigan that can defend you and your rights.

Title IX Accusation Potential Consequences

Suspension

A suspension can have severe consequences on your future. It could make it difficult to get into another school as well as affect your graduation. This serious interruption of studies can possibly be avoided with the help of a Title IX Lawyer in Michigan that has your best interest in mind and also knows the law. Getting a suspension can be career-altering if you cannot get into a university or college to continue and complete your studies.

How will the other university find out that you have a suspension? Upon filling out the transfer application, you will be asked to sign a FERPA form. This allows the first school to send your records to the school you are transferring to. This will contain the suspension information and the investigative findings.

Expulsion

In the event you are expelled, this information will also be included in your records. When you apply to a new school, you will need to address the reasons for expulsion. If you fail to disclose the disciplinary action and the school becomes aware of it, your acceptance can be revoked.

Degree Revocation

In some cases, universities will revoke your degree upon the findings of a Title IX violation or any other student misconduct, for that matter. If you have already gotten a degree and were working on adding to it, you might want to consider hiring a Title IX Attorney in Michigan to better represent you.

Loss of Financial Assistance or Athletic Scholarship

According to the National Collegiate Athletic Association, if a student cannot be as involved with their sports activities as planned, the university can reduce or cancel the scholarship. When a student is found guilty of serious misconduct, the discipline might be that they can no longer continue playing sports or intercollege activities. This could threaten their scholarships and financial assistance. A Title IX lawyer in Michigan will address these issues.

Loss of Eligibility

Being accused of a Title IX violation may result in a student losing his or her eligibility to be a part of college athletics. This could mean not only academic but also athletic and financial consequences due to lost scholarships or professional career opportunities.

Loss of Leadership Positions

For those students who participate in leadership roles within student organizations, they may be removed from such positions if accused or found guilty of a Title IX violation.  A student that is active in the military and working as a cadet in the ROTC program could face disenrollment, loss of a scholarship, forfeiture of a military commission, and immediate repayment of previous scholarships already awarded.

How We Can Help

We work with students to provide counsel and advice to help navigate the difficulties and stress of Title IX proceedings. We understand the laws and actively participate in the Title IX investigations, support the student and counsel them when needed. When there are associated misdemeanor or felony charges, we are there to assist in court. A Title IX Attorney in Michigan is on your side, helping you each step of the way.

Title IX Investigations

Your rights should be upheld throughout the process. This means that you are included in all aspects of the Title IX investigation. The investigation process includes:

  • Notifying all parties involved
  • Gathering evidence
  • Reviewing all information
  • Writing the report of the findings

You are allowed to have an advisor, such as a Title IX lawyer, present at every meeting and the right for you both to review the evidence that was gathered against you. You and your Title IX attorney will also receive a copy of the investigation report once complete.

Investigations typically will take approximately 60 days. However, there is no law that states they have to be completed in that amount of time. Sometimes, if the case is complex, it could take longer. According to the DOE Office for Civil Rights, the length of the investigation will vary based on factors such as the number of witnesses, incidents, and complainants.

Ensure You Receive Due Process and Fairness and Hold the College Accountable

There are federal guidelines in place for these cases. A Title IX lawyer in Michigan will hold the university accountable and protect your due process rights. Due process is in place for a reason, and without a Title IX attorney, you might not get your fair shake. Proper representation ensures your rights are protected and that you have a strong defense through the investigation and hearing process.

Cross-Examination

Cross-examination is an effective tool in testing the credibility of the witnesses. Both parties will have the opportunity to question witnesses, as well as the other party, at a hearing. Advisors cannot ask about the past sexual behavior of the complainant. They can only ask questions that are relevant to that particular case.

Gathering Evidence

A Title IX attorney will help prepare your opening statement and help prepare you for your interviews. They will also assist you in the collection of evidence and finding witnesses to get their statements.

Preventing and Pursuing Retaliation Claims

Whatever you do, don’t try to contact your accuser, or this could be considered retaliation. Do not try to contact them in any way, whether in person, over the phone or through text or email. Retaliation claims are prevalent. You can also be considered responsible if a third party contacts the accuser. The best thing to do is to sit and let the investigations figure it out. If you experience similar retaliation due to the nature of the allegations, your Title IX lawyer in Michigan can also assist and pursue a retaliation claim on your behalf.

Civil Suit Defense

You may find yourself sued by your accuser, even if you were not found guilty of policy violations. Your Title IX attorney in Michigan will defend you in such a case.

Defense Against Criminal Charges

Our attorneys have the experience necessary to help you handle felony or misdemeanor charges in court. If you are found in violation of school policies and charges are brought on, your Title IX lawyer in Michigan who has been by your side during the investigations already knows the case and evidence and can therefore help you build an effective defense.

Michigan is known as the Great Lake State and is surrounded by large bodies of water called the great lakes. These are:

  • Lake Michigan

However, it is also full of inland lakes throughout the state. Visiting the lakeside regions, you can enjoy many different lighthouses and beaches. These areas also have a rich history, as much of Michigan was occupied by Native American Indians at one point.

Large Cities of Michigan

Some of the larger cities and towns in Michigan are:

  • Detroit
  • Grand Rapids
  • Lansing (the state capital)
  • Ann Arbor
  • Flint
  • Saginaw
  • Kalamazoo
  • Cadillac
  • Traverse City

It is comprised of two peninsulas, the lower and the upper peninsula, which are connected by a large suspension bridge from Mackinac City to St. Ignus, which is about 5 miles long. Many people like to visit the Upper Peninsula (UP) due to its amazing natural beauty.

While you are visiting Mackinac Bridge, you might want to leave a day to visit Mackinac Island. This is a small island that hosts visitors from around the world. Here it is like stepping back in time. You won’t find engines on the island as everything is done with horses, bikes, and buggies. You will find historic forts, various shops to enjoy, and a state park on the island.

Natural Beauties of Michigan

Michigan has many natural resources to enjoy and is beautiful in the summer. Here you will also find many state parks. In fact, it has over 100 state parks, including Saugatuck Dunes State Park, Holland State Park, and Yankee Springs Recreation Area.

Some familiar places that people like to visit in the state are Frankenmuth, home to the largest Christmas store. This bavarian-style town is very quaint and has many festivals going on year-round. It also has the beautiful bavarian style that many people come to see, rich with cuckoo clocks and german food.

Traverse City is another location that is further north that is simply gorgeous and isn’t too far from Petosky, which is where the Petosky stones or fossils are found. Many people flock there in hopes of finding one in the waters or along the beaches. Both of these locations have harbors that can be used for staying on your boat. In fact, due to the great lakes, there are many amazing beach towns along the state’s shores.

Of course,  there are some zoos in the state! The Detroit Zoo, John Ball Zoo in Grand Rapids, Binder Park Zoo, Potter Park Zoo, Roscommon Zoo, and More.

Michigan is also home to some theme parks that you don’t find in other states, such as Nell’s Dutch Village, Avalanche Bay Indoor Waterpark, Michigan’s Adventure, and Dinosaur Gardens, to name a few.

A Client’s Tips For Facing A Title IX Investigation

I OFFER THE FOLLOWING TIPS

For students who may be involved in a Title IX or related matter, I offer the following tips. First, I recommend that you call a Title IX lawyer before you make any other move. Following that step, one should consider staying away from public statements on the matter. I also recommend that this public silence be countered with engagement in therapy and frequent self-care. Similarly, reach out to the appropriate contact at your school to coordinate supportive measures so that you may continue with your academics. Establishing a list of hobbies and rituals to ground myself was incredibly helpful throughout the ups and downs of the case.

We cannot thank you enough for your prompt and professional services on our behalf. You accomplished an amazing feat in just a few months. We are so grateful. You followed up on every issue and kept us informed throughout the process. It has been wonderful working with such competent attorneys as you have been. We will be forever grateful to you for engaging with us to assist our son in this most difficult situation.

Kristina and Susan are very competent ...

and experienced attorneys in Title IX and higher education law who treat their clients with integrity and compassion. Highly recommend this team!

Susan Stone and Kristina Supler represented our male college freshman...

against a false Title IX claim of non-consensual sexual intercourse. Current Title IX laws are strongly slanted in the accuser’s favor, and our son was denied due process by the university. This legal team expertly highlighted the accuser’s false accusations, while exposing the university’s many inconsistencies. They were there when we needed them – quick to take our phone calls or respond to our questions and concerns. Without their expert legal advice, our son would have likely been another silent and unfortunate victim of current Title IX university policies. We give Susan and Kristina the highest of recommendations!

I was a member of a fraternity at a public university...

that was kicked off campus for reported hazing. My involvement with the fraternity was unaware of any misdeeds being done, and was shocked when the school charged me with failure to report hazing. That’s when I contacted Susan and Kristina, who were extremely helpful and wonderful to work with. Thanks to them they helped guide me through collecting proof of my innocence, which ended up leading to the result we wanted of no charges against me. I highly recommend their service to anyone who might need it!

You are the utmost professional counselor...

On behalf of my family and me, I would like to thank you for the excellent guidance you provided to us. You are the utmost professional counselor. We are grateful for your expertise during a difficult time.
