What Is Title IX?

Title IX of the Education Amendments of 1972 is a federal law that prohibits discrimination on the basis of sex for educational institutions and programs that receive federal funding. A significant component of this law is to prevent sexual assault. Sexual assault under Title IX involves any nonconsensual sexual act, including rape, coerced or forced sexual touching, or other forms of sexual violence.

Title IX applies to various forms of sexual misconduct, including:

  • Sexual assault crimes
  • Unwanted sexual contact
  • Sexual harassment
  • Domestic violence
  • Dating violence
  • Relationship abuse
  • Stalking

Because colleges can lose federal funding if they do not investigate allegations of sexual misconduct, many schools act promptly and take these accusations seriously, sometimes trampling over the rights of the accused.

What Is the Title IX Adjudication Process?

While Title IX is a federal law, Title IX cases are handled under the individual school’s or college’s policies. Every school is responsible for creating and enforcing its own sexual misconduct policies under Title IX. Matters may proceed differently, but the general process of a Title IX case includes the following steps:

  • Filing of a formal complaint
  • Notifying the parties of the allegations and their rights under Title IX
  • Investigating the allegations and preparing an investigative report
  • Providing an opportunity to respond to the investigative report
  • Preparing of a final investigative report
  • Participating in alternative dispute resolutions
  • Attending a hearing
  • Receiving the outcome

Again, your school’s specific Title IX procedures will dictate the particular process. Our lawyers can confidently guide you through each phase of your case.

Possible Consequences of a Title IX Finding of Responsibility

Colleges and universities must investigate allegations of sexual assault and other forms of sexual misconduct under Title IX’s mandates. These investigations can result in life-changing consequences for the accused if they are found responsible for violating Title IX. Supportive measures could immediately impact you even if you have not yet been found responsible, such as being forced out of your dorm or required to withdraw from a class your accused attends.

Title IX’s academic consequences can include suspension or expulsion, which can hinder your education and make it difficult for you to transfer to another school. These consequences will be included on your permanent record. Other possible consequences of a Title IX finding of responsibility include:

  • Loss of financial assistance
  • Loss of athletic scholarships and eligibility to participate in collegiate sports
  • Degree revocation
  • Loss of leadership positions
  • Loss of student housing

If you are accused of sexual assault crimes, you could face prosecution through the county attorney’s office and consequences that include jail time, fines, and registration as a sex offender.

When facing such dire consequences, working with an experienced Title IX and criminal defense lawyer is critical.

New Hampshire Colleges and Universities

Title IX charges can arise in any educational institution or program that receives federal funding, but these cases are most common in the college setting. The University of New Hampshire consists of six colleges and twelve private schools, including four four-year colleges. Some of the most well-known colleges and universities in New Hampshire include:

  • Dartmouth College
  • University of New Hampshire
  • Southern New Hampshire University
  • Plymouth State University
  • Keene State College
  • New England College
  • Saint Anselm College
  • Colby-Sawyer College

If you are facing Title IX allegations in any of the above educational institutions, contact our legal team today for a confidential case review.

Essential Considerations for Title IX Cases

Title IX cases are complex. Many people are ill-prepared to handle these types of cases. Some important things to know about the Title IX process include:

The Accused Might Be Better Protected

Consequences stemming from Title IX violations can be severe, including those taken against colleges and universities that fail to promptly and appropriately investigate complaints. Sexual misconduct investigations tend to protect the alleged victim more than the accused. For this reason, having a knowledgeable advocate on your side is essential to ensure that your due process rights are protected.

Schools May Serve Multiple Roles

Schools may take on multiple roles during the investigative process. They may serve as judges, juries, and investigators. This is another reason why you want to choose a knowledgeable lawyer as your advisor, who can ensure that these roles do not create conflict or bias.

Title IX Is Constantly Evolving

Today’s version of Title IX is much different than its original form. Some schools and universities may not be up-to-date on the latest laws and procedures. A lawyer can ensure that the school recognizes the most current requirements or appeal your case if it does not.

Title IX Cases Can Involve Criminal Accusations

Title IX allegations often involve conduct that falls within the criminal code. It’s essential you hire a lawyer who has experience handling Title IX cases and criminal charges. You don’t want to say or do anything that could subject you to even harsher consequences. Our legal team can confidently advise you during the Title IX process.

Additional Legal Services Offered by KJK Student & Athlete Defense

If you are accused of violating your college’s or university’s Title IX policies, other areas of law could be implicated. KJK Student & Athlete Defense provides high-quality legal representation in associated legal claims, including:

Criminal Defense

If your Title IX case is referred to local prosecutors, you could face criminal charges for similar conduct that underlines your Title IX case. This can increase the importance of not doing or saying anything that could incriminate you in the criminal proceeding. A criminal defense attorney from our firm can represent you in the criminal case and zealously advocate for you every step of the way.

Retaliation Claims

It’s crucial that you do not try to contact the accuser after an accusation. A no-contact order may be in place that prohibits such conduct. Additionally, your accuser could claim you are trying to retaliate against them. Our attorneys can advise you on what to do and not to do following a Title IX complaint. If anyone has retaliated against you, we can safeguard your rights.

Civil Suit Defense

If your accuser decides to sue you, we can defend you in civil court. These charges can arise even if there is no finding of responsibility against you in your school’s Title IX case. We can represent you during any civil litigation that arises out of a Title IX case.

Reputation Management and Content Removal

Negative information about you could be circulating online following a Title IX accusation. Our legal team can help remove this information to protect your reputation and academic career.

A Client’s Tips For Facing A Title IX Investigation

I OFFER THE FOLLOWING TIPS

For students who may be involved in a Title IX or related matter, I offer the following tips. First, I recommend that you call a Title IX lawyer before you make any other move. Following that step, one should consider staying away from public statements on the matter. I also recommend that this public silence be countered with engagement in therapy and frequent self-care. Similarly, reach out to the appropriate contact at your school to coordinate supportive measures so that you may continue with your academics. Establishing a list of hobbies and rituals to ground myself was incredibly helpful throughout the ups and downs of the case.

Kristina and Susan are very competent ...

and experienced attorneys in Title IX and higher education law who treat their clients with integrity and compassion. Highly recommend this team!

Susan Stone and Kristina Supler represented our male college freshman...

against a false Title IX claim of non-consensual sexual intercourse. Current Title IX laws are strongly slanted in the accuser’s favor, and our son was denied due process by the university. This legal team expertly highlighted the accuser’s false accusations, while exposing the university’s many inconsistencies. They were there when we needed them – quick to take our phone calls or respond to our questions and concerns. Without their expert legal advice, our son would have likely been another silent and unfortunate victim of current Title IX university policies. We give Susan and Kristina the highest of recommendations!

I was a member of a fraternity at a public university...

that was kicked off campus for reported hazing. My involvement with the fraternity was unaware of any misdeeds being done, and was shocked when the school charged me with failure to report hazing. That’s when I contacted Susan and Kristina, who were extremely helpful and wonderful to work with. Thanks to them they helped guide me through collecting proof of my innocence, which ended up leading to the result we wanted of no charges against me. I highly recommend their service to anyone who might need it!

You are the utmost professional counselor...

On behalf of my family and me, I would like to thank you for the excellent guidance you provided to us. You are the utmost professional counselor. We are grateful for your expertise during a difficult time.
